Dallas City Code §47A-2.1.6 requires an operating authority to maintain and enforce a zero-tolerance policy prohibiting drivers from using intoxicating substances. It also requires the policy and instructions for reporting suspected violations to both the company and the City to be publicly available online.

1. Purpose

There and Back Transportation is committed to providing safe, professional, and reliable transportation-for-hire services. In accordance with Dallas City Code §47A-2.1.6, the Company maintains and enforces a strict zero-tolerance policy regarding the use of intoxicating substances by its drivers.

2. Zero-Tolerance Standard

Drivers are strictly prohibited from using or being under the influence of any intoxicating substance while:

Operating a vehicle on behalf of the Company;
Providing transportation-for-hire services;
Transporting or preparing to transport passengers;
On duty or available to accept transportation assignments; or
Performing any safety-sensitive duties on behalf of the Company.

Definition of Intoxicating Substances: For purposes of this policy, intoxicating substances include alcohol, illegal drugs, controlled substances used unlawfully, marijuana, and prescription or over-the-counter medications when their use impairs or could reasonably impair a driver's ability to safely operate a motor vehicle.

No driver may operate a transportation-for-hire vehicle while impaired or while his or her ability to safely operate the vehicle is adversely affected by an intoxicating substance.

3. Enforcement

  • The Company will take all reports of suspected violations seriously.
  • When the Company receives a credible complaint or otherwise has reasonable grounds to believe that a driver may have violated this policy, the Company may immediately remove the driver from transportation-for-hire service while the matter is investigated.
  • A driver determined to have violated this policy may be subject to disciplinary action, including suspension or permanent termination of the driver's relationship with the Company, as permitted by applicable law and Company policy.
  • Drivers are required to cooperate with any investigation involving a suspected violation of this policy.

4. Passenger Safety Instructions

Immediate Threat Procedure:

A passenger who reasonably suspects that a driver is under the influence of alcohol, drugs, or another intoxicating substance should discontinue the trip when it is safe to do so.

If there is an immediate threat to the safety of the passenger or the public, the passenger should call 911 immediately.

5. Report Violation to the Company

6. Report Violation to City of Dallas

Passengers may also report suspected violations directly to the City of Dallas independently of any report made to the Company:

Passengers may submit a complaint to the City of Dallas at any time. Reports made to the City are handled under the authority of the Dallas Transportation Regulation Division.

7. Public Notice

In accordance with Dallas City Code §47A-2.1.6, the Company will maintain notice of this Zero-Tolerance Policy on its publicly accessible website or other publicly remotely accessible data site. The website provides information explaining how passengers may report a possible violation to both the Company and the City of Dallas.

8. Driver Acknowledgment

All drivers affiliated with There and Back Transportation are required to comply with this policy as a condition of providing transportation-for-hire services on behalf of the Company. By operating under the Company's authority, each driver acknowledges the Company's prohibition against the use of intoxicating substances and agrees to comply with this Zero-Tolerance Policy at all times while providing transportation-for-hire services.
